Proof of Claim Events and Relationship to New York CVA

On February 23, 2021, the Official Committee of Unsecured Creditors (the “Committee”) filed a motion asking the bankruptcy court to extend the deadline for filing proofs of claim in the Diocese of Syracuse bankruptcy case. The Committee filed this motion because the Diocese of Syracuse had inaccurately posted the wrong proof of claim deadline on its website, among other reasons. Adversary Proceeding

On January 15, 2021, the Diocese of Syracuse initiated an adversary proceeding against insurers who issued insurance policies to the Diocese of Syracuse at times during which survivors were sexually abused. The adversary proceeding, which is an ancillary proceeding connected to the Diocese of Syracuse’s bankruptcy case, is designed to resolve disputes between the Diocese of Syracuse and its insurers regarding whether the Diocese of Syracuse’s insurance policies cover the claims of sexual abuse survivors.

2004 Motion

On November 3, 2020, the Official Committee of Unsecured Creditors’ (the “Committee”) filed a motion pursuant to Bankruptcy Rule 2004 requesting that the bankruptcy court order the Diocese of Syracuse to provide discovery relating to its assets, among other things. Since then, the bankruptcy court has “continued” the motion on several occasions, while the Committee and the Diocese of Syracuse work informally to facilitate the transfer to the Committee of documents the Committee is entitled to. These efforts have resulted in the Diocese of Syracuse producing thousands of pages of documents to the Committee.
